Terms of Service
These terms govern access to and use of the Nickaela ONE website, trial and organisation-management application.

1. Agreement and eligibility
By creating an account or using Nickaela ONE, you agree to these terms. You must be legally able to enter this agreement and, when acting for an organisation, authorised to bind that organisation.
2. Accounts and authorised users
You must provide accurate information, protect login credentials and keep authorised-user access current. You are responsible for activity performed through your organisation workspace, except where caused by a failure of Nickaela ONE. Notify us promptly about suspected unauthorised access.
3. Trial, plans and subscriptions
Eligible customers may receive a 14-day trial without providing a payment card. A paid plan is required to continue using paid features after the trial. Plan features, user limits, prices and applicable taxes are shown before subscription. Displayed VUV conversions may be approximate. Recurring or gateway payments will only operate after the relevant payment service has been configured and verified.
4. Customer data
You retain ownership of information submitted to your workspace. You grant Nickaela ONE the limited permission needed to host, process, back up and display that information to provide the service. You are responsible for the accuracy, legality and required consent for data you enter, including personal and financial records.
5. Acceptable use
You must not use the service to break the law, infringe rights, distribute malware, attempt unauthorised access, bypass security or plan limits, interfere with availability, scrape the service at unreasonable scale, or upload content you have no right to use.
6. Service changes and availability
We work to keep Nickaela ONE reliable and may maintain, improve, replace or discontinue features. Temporary interruptions may occur for maintenance, security incidents or matters outside reasonable control. Where practical, we will provide notice of material changes affecting paid customers.
7. Third-party services
Some functions depend on third-party providers such as hosting, authentication, communications or payment services. Their own terms and availability may apply. Nickaela ONE is not responsible for a third-party service beyond what the law requires.
8. Intellectual property
Nickaela ONE and its software, design, branding and documentation are protected by intellectual-property laws. These terms give you a limited, non-exclusive, non-transferable right to use the service for your organisation while your account is authorised and in good standing.
9. Suspension and termination
You may stop using the service at any time. We may restrict or suspend access when reasonably necessary for security, non-payment, unlawful use or a serious breach of these terms. Where appropriate, we will provide notice and a reasonable opportunity to correct the issue.
10. Disclaimers and responsibility
Nickaela ONE supports administration and reporting but does not provide legal, tax, accounting or financial advice. You remain responsible for reviewing records, reports and AI-assisted output before relying on them. The service is provided with reasonable care, but uninterrupted or error-free operation cannot be guaranteed.
11. Limitation of liability
To the maximum extent permitted by law, Nickaela ONE is not liable for indirect, incidental or consequential loss, lost profits or loss caused by unauthorised use of your credentials. Nothing in these terms excludes rights or liability that cannot legally be excluded.
12. Governing law
These terms are governed by the laws of the Republic of Vanuatu. The parties should first try in good faith to resolve any dispute through direct discussion before starting formal proceedings.
